Few things are more disruptive to business than litigation. It distracts your leadership and drains valuable resources, and often endangers the very survival of a business. Our Trial Team members bring to bear decades of “in the trenches” court experience, advanced business degrees, and years of hands-on business management to confront your disputes.
Because prevention is always the best approach, we partner closely with our clients to identify potential legal exposure early and create effective business and legal strategies to manage that risk. We help our clients develop essential policies and procedures that minimize risk in day-to-day business operations, such as employment or document retention and destruction policies. We conduct legal audits to uncover potential areas of risk, and provide a broad range of group or one-on-one training on compliance and risk issues.
When litigation is required, we execute on our strategic, high-tempo approach to litigation. For over two decades our team has handled evidentiary hearings and trials in state and Federal courts throughout the country. We work closely with our clients to prepare concrete objectives and timelines for pretrial discovery, the selection and preparation of witnesses and expert witnesses, motions practice, and summary judgment. And we leverage the latest technologies to help drive our strategy. As appropriate, we lead our clients in all manner of alternative dispute resolution procedures, including mediation, “mini-trials,” and arbitration.
Our representations have included a wide range of clients and matters, such:
- Representing The Tesoro Club in ground-breaking, post-acquisition litigation over restructuring club memberships and liability for over $30 million in membership initiation deposits;
- Successfully defending a prominent local family and its historic Florida business in four separate lawsuits brought by their long-time lender;
- Prosecuting breach of fiduciary duty, fraud, and dissolution claims on behalf of partners and other business owners;
- Representing First Southern Bank and other financial institutions in commercial foreclosures and follow-on guaranty litigation;
- Defending the University of Miami in potential litigation claims arising from the Nevin Shapiro ponzi scheme;
- Representing numerous local and national retailers in the defense of class actions, including FACTA privacy claims;
- Prosecuting breach of fiduciary claims against officers and directors of insolvent companies.
